Role Description
A litigation professional tomanage litigation, enforcement, and recovery actions arising out oftrusteeship and allied fiduciary transactions. The role involves representing the interests of debenture holdersacross various judicial, quasi-judicial, regulatory, and enforcement forums while ensuring effective legal strategy, stakeholder coordination, and regulatory compliance.
Qualifications
Key Responsibilities
Manage and oversee litigation matters connected withtrusteeship transactions, including defaults, enforcement actions, recovery proceedings, and investor protection measures.
Represent the company and debenture holders before judicial and quasi-judicial forums including NCLT, DRT, High Courts, Civil Courts, Magistrate Courts, and other regulatory or statutory authorities.
Coordinate and brief external counsels, senior advocates, solicitors, and recovery agencies in relation to ongoing litigation and enforcement matters.
Initiate and monitor proceedings under the Insolvency and Bankruptcy Code(IBC), SARFAESI Act, Companies Act, and other applicable laws for protection and recovery of debenture holder interests.
Appear before governmental, police, and investigative authorities as may be required in connection with disputes, complaints, frauds, or enforcement actions.
Draft, review, and vet legal notices, pleadings, affidavits, applications, agreements, settlement documents, and enforcement-related documentation.
Advise internal teams on litigation strategy, legal risks, recovery mechanisms, and regulatory implications arising from default scenarios.
Coordinate with debenture holders, issuers, lenders, valuers, security agencies, and other stakeholders for effective resolution and recovery.
Provide periodic updates to investors and management regarding litigation status, enforcement actions, and recovery progress.
Eligibility & Experience
LLB / LLM from a recognised university or institution.
Minimum 6 years of relevant experience with a Debenture Trustee, Bank, NBFC, ARC, Law Firm, Financial Institution, or corporate organisation handling litigation and enforcement matters.
Prior experience in handling matters relating to debt recovery, insolvency proceedings, security enforcement, and investor-related disputes is mandatory.
Strong working knowledge of SEBI regulations, Debenture Trustee framework, Companies Act, Insolvency & Bankruptcy Code, SARFAESI Act, and allied laws.
