Essar Constructions India Limited (ECIL) is the Indian arm of Essar Projects, which focusses on India and the Sub-continent. It also has a multidisciplinary skilled and experienced Engineering & PMC division which provides a comprehensive array of value added technical engineering services, in a structured manner, across diverse sectors. It is fully geared to service global clients by providing end-to-end engineering solutions from feasibility studies and scope documents to design conceptualization, FEED, detailed design, PMC, field engineering, commissioning and start up assistance and also debottlenecking for efficient plant operations.

Job Purpose:

Spearhead and assist in Domestic & international litigation with emphasis on GCC litigation

Initiate and defend arbitration in Indian & international jurisdictions

Dispute settlement participation in contractual discussions

Assisting financing transactions in domestic & international domains

Participating in bid/tender/documentation development with contracts team

Advisory on multiple fronts in Contracts, commercial, tax, employment and compliance matters

Accountabilities & Responsibilities:

Lead in Domestic & international litigation:

Engaging lawyers, Preparation of case brief, Monitoring developments & MIS

Participating in Arbitrations in Indian & international jurisdictions:

Leading the dispute resolution

Following the process in arbitration

Implementation/defending the award

Appeal where needed to secure interests

Document preparation relating to financing transactions in domestic & international domains:

Develop standard templates for financing

Examine hypothecation/mortgage deeds

Execution of POA and chain of documents related to activity with secretarial assistance

Examining the contracts/ contractual provisions & conditions:

Give inputs on various types of contracts

Modifying the clauses as tailor made to job

Advisory on matters of concern:

Advising the groups and teams on tax, labour and other related queries time to time

Dispute settlement participation in contractual discussions:

Giving a roadmap of dispute to stand at law

Suggest the best alternatives to guide from the front

Knitting of SPA, SHA and similar docs:

Drafting the agreements securing commercial interests

Organise legal work shops and shop floor knowledge dissemination:

Organise workshops at necessary levels

Key Challenges:

To coordinate with lawyers, courts and associates in Indian and international jurisdictions, and coordinating between India and overseas entities of the group.

To develop legal acumen for contract execution in the domains listed for effective problem solving and strategy.

Qualification:

Bachelors degree in Law (LLB), Masters of Law (LLM) preferred.
